Davenport clerk arrested for illegal alcohol sale

Media Contact: Brian Bruchey, PIO

A Davenport sales clerk was arrested Tuesday, April 15, 2025, after he sold an alcoholic beverage to a 17-year old girl.

What the clerk wasn't aware of, was that the girl is a member of the Polk County Sheriff's Office Cadet 1000 program, and she was there to assist deputies during the Operation Pop-Top campaign.

The girl and the deputies visited ten stores in the Davenport area on Tuesday to ensure they were compliant with state law that prohibits the sale of alcoholic beverages to anyone under 21 years of age.

Nine of the stores refused to sell to the girl, but one did, and that resulted in the arrest of the store clerk who sold it.

45-year old Daniel Lugo Morales from the 7-Eleven store at 1223 Finley Avenue in Davenport, was arrested and charged with Selling Alcohol to a Person under 21 Years of Age, a misdemeanor.

"This is very important, and store clerks and their management need to be checking IDs and refusing sales to anyone under 21. These surprise visits are conducted often, so if you're a store employee, it would behoove you to act within the law, or it might be you going to jail next time." - Grady Judd, Sheriff

Additionally, two smoke shops were also checked, and both refused to sell Kratom to the girl.

Kratom is also not to be sold to anyone under 21 years of age.
